1. Purpose
These terms govern your use of the Video Delay app. By installing or using the app, you accept them. If you do not accept them, do not use the app.
The app is distributed through Apple's App Store. Apple's standard Licensed Application End User License Agreement also applies; these terms supplement it and, where they conflict on a point the Apple agreement settles, the Apple agreement prevails.
2. Licence
We grant you a personal, non-exclusive and non-transferable right to use the app on the Apple devices you own or control, in line with the App Store usage rules, including in a club, school or training facility.
You agree not to: rent, resell or redistribute the app; decompile or reverse engineer it beyond what the law mandatorily allows; get around its pairing, encryption or server-protection mechanisms; send false or automated data to our servers; connect to a device you are not authorised to use.
3. Intended use
Video Delay is a training tool: it films a sporting movement and plays it back a few seconds later, records it, and, for archery, finds its key moments and estimates some measurements.
Measurements are estimates. Arrow speed is worked out from sound and the distances you enter: it is approximate (around ±3 km/h in good conditions), it is an average over the flight, and it may be wrong or missing beyond 30 metres, in a noisy place, or if the distances entered are inaccurate. Key moments, time at anchor, the skeleton and statistics are computed automatically and can be wrong. None of these measurements is certified, or usable as an official, safety, medical or equipment-inspection measurement.
Safety remains yours. Place the phone and tripod where they get in nobody's way, never in front of the shooting line or in a line of flight. Do not watch the screen during a movement that needs your attention. Safety on a range is the responsibility of whoever runs it, never of the app.
Your equipment. Filming for a long time warms the phone and uses the battery; continuous arrow analysis uses more. The app lowers its quality or stops when the phone is too hot.
4. The people you film
You are responsible for what you film. If other people appear in your takes, make sure you have their agreement to film them, to record the takes and to share them; for a minor, their parents' agreement. Do not turn on sending poorly detected takes if people who have not agreed appear in them.
You must not use the app to film someone without their knowledge, or to infringe their privacy or image rights.
5. Your videos
Your takes belong to you. They stay on your phone unless you save them to Photos, share them, or agree to sending poorly detected takes.
If you agree to that sending, you authorise us, free of charge, to keep the takes sent and use them to train, evaluate and improve the app's detection model, for as long as that work lasts. We do not publish them, show them outside the team working on it, or use them for advertising. You can withdraw this authorisation at any time in Settings, and ask for a take already sent to be deleted as described in the privacy policy.
Keep a copy of the takes you care about: deleting the app erases its gallery, and we keep no backup of it.
6. The questionnaire
On first launch, the app asks how you found it and which sports you will use it for. The sport is used to set the app up; you can change it in Settings. Answers are counted anonymously, as described in the privacy policy.
7. Price, purchases and refunds
The app is free. It has no subscription, no in-app purchase and no account to create. Any refunds are handled by Apple under its own terms.
8. Third-party links and content
The app offers a link to the CapTarget Archery app on the App Store, where the terms and privacy policies of Apple and of that app apply.
9. Intellectual property
The app, its code, name, icons, detection models and graphics remain our property or that of our licensors. These terms transfer no intellectual property right to you. "Apple", "iPhone", "iPad" and "Mac" are trademarks of Apple Inc. CapTarget is a trademark of its owner.
10. Privacy
How your data is processed is described in the privacy policy.
11. Changes and availability
We may change the app, modify or remove features, and stop publishing or updating it. It depends on operating system versions and devices that Apple changes; some features, such as 240 frames per second, exist only on some iPhones. We do not guarantee permanent compatibility with every past or future version.
12. Warranties and liability
The app is provided "as is". To the extent permitted by law, we do not guarantee that it will work without interruption or error, that its measurements will be accurate, or that it will suit a particular purpose.
To the extent permitted by law, we are not liable for indirect damage resulting from its use, including a lost or unrecorded take, an inaccurate measurement, a broken link between devices, a device damaged by a fall or by heat, or a training decision made on the strength of a measurement.
These limitations do not apply in case of gross negligence or wilful misconduct, personal injury, or where the law forbids them. If you are a consumer, your statutory rights remain applicable in all cases, including the legal guarantee of conformity and the warranty against hidden defects.
13. Termination
You can stop using the app at any time by deleting it from your devices. This erases what it had stored locally, takes included.
14. Governing law
These terms are governed by French law. If you are a consumer living in another European Union country, you keep the benefit of the mandatory consumer protection provisions of the law of your country of residence. Failing an amicable settlement, the competent courts are those designated by law.
15. Changes to these terms
We may change these terms; the date at the top of the page will change, and the applicable version is the one published at this address. Continuing to use the app after a change means you accept it.
